This Privacy Policy and Notice (we refer to it as our “Privacy Policy”) describes how Excelion Partners LLC (“Excelion, the “Company,” “we” or “us”) collects, uses, shares, retains, and protects information about you when you (1) visit us at https://www.excelionpartners.com/, or one of the pages thereon, including https://www.excelionpartners.com/careers#apply (the “Website”); (2) communicate with us or on the Website via email and other electronic messages; (3) “login” and create an account on our Website; (4) agree to email or texting services from or with us; or (5) otherwise interact with us online and in our application process (as described below).

Your privacy is extremely important to us and so is being transparent about how we collect, use and share information about you. We adopt this Privacy Policy to fulfill our service commitment to you and comply with legal obligations as we process personal information, described below.

Our Website may contain links to partner companies and third-party websites. This Privacy Policy does not apply to information collected or used by any third party, affiliate, or affiliate of a third party, including those that may link to or can be accessible via the Website. Please review their policies. 

Before accessing, using, or interacting with the Website you should carefully review this Privacy Policy. We may change our Privacy Policy from time to time and encourage you to review it whenever you interact with us. 

User Consent: By choosing to interact with us, including through our Website and by communicating with us via email, you consent to the collection and use of information as described in this Privacy Policy. If you are under the age of 18 or you do not consent to the collection, use and/or disclosure of your personal information as set forth in this Privacy Policy, please exit and do not use our Website or other applications or services. If we learn we have collected or received personal information from a person under the age of 18, we will delete that information.

What Personal Information Do We Collect?

When we use the term “personal information,” we mean information that identifies, relates to, describes, references, is reasonably capable of being associated with or could reasonably be linked, directly or indirectly, with a particular person or household. We collect various types of personal information in the recruiting and application process and, if you are hired, for purposes of your employment. 

We may collect personal information that falls into the following categories:

  • Identifiers: real name, alias, postal (home/mailing) address, email address, telephone number, contact information of any referrals, references or emergency contacts you provide, relevant licenses, and certifications  
  • Protected Classification Characteristics: sex, age, race, disability, medical or health conditions and information, federal work status, and marital status, together with associated information to understand and assess accommodation requests regarding potential disabilities or other health conditions. If required by the Department of Labor, we may also collect background check information if necessary to complete a background check, when permitted by law
  • Professional or Employment-Related Information: current or past job history, as reflected in your application and/or resume, performance evaluations, references, employment history, skills, communications, wage and salary data, and eligibility for employment
  • Education-Related Information: if you elect to include this information with your application or resume
  • Career Planning Information: your career interests, desired compensation and benefits, desired work location and willingness to relocate, family information as it relates to your career goals or plans, and hobbies and interests
  • Account information: including your username and password when you choose to establish an account with us
  • Electronic Device Data: if we need to investigate a cybersecurity issue or concern, your Internet Protocol (IP) information, browser type and version, time zone setting, browser plug-in types and versions, location information on a city-regional basis and operating system and platform information when you are visiting our Website; 
  • Data Through Online or Website Interaction: if you browse our open positions on Excelion’s Careers page or apply online for a job with one of Excelion’s partners, anonymized analytics and/or Cookies, as well as photos that you provide to us or that you make publicly available on the internet (e.g., LinkedIn or company/firm websites). 
  • Onsite Information for Safety and Security: if you are on Excelion’s property for an in-person interview or using Excelion’s equipment, potentially, your name and photo identification (if you register at security), and security footage. Please see our Security Camera signs for more information. 

We also collect, use and share Aggregated Data such as statistical or demographic data for certain legitimate, business purposes. Aggregated Data may be derived from your personal information but is not considered personal information as this data is deidentified data and is not reasonably capable of being associated with or reasonably linked, directly or indirectly, with a particular person or household. For example, we may aggregate your usage data to calculate the percentage of users accessing a specific website feature. In certain instances, this aggregated data is not deidentified; and, if we combine or connect Aggregated Data with your personal information whereby it could directly or indirectly identify you, we treat the combined data as personal information which will be treated in accordance with this Privacy Policy.

We do not collect any Special Categories of Personal Data about you. Nor do we collect any information about criminal convictions and offenses.

How Do We Collect Information About You?

  • We may collect your first name, last name, company name, job title, email address, and phone number when you register an account with us, download materials or documents from our Website, or register or attend a virtual event offered on our Website;
  • We may collect your first name, last name, mailing address, email address, phone number, resumes, CVs, and other applicant data,  when you apply for a position through LinkedIn, ZipRecruiter, Indeed, or any other trusted partners who collect such applicant data; 
  • We may collect your first name, last name, company name, email address, phone number and country/region if you sign-up for email notifications or text messages. We may use a platform maintained by a Third-Party service provider when you opt-in to email messaging and text messaging; 
  • We may collect your first name, last name, address, phone number, education, federal work status, and past and current employment history and job status if you apply for employment with us. We may collect information from you, when you register or attend an event; and,
  • We may ask you for information to enable us to provide a service to you and we collect this information by telephone, written/digital correspondence, or via the website. 

We also receive and store certain types of information automatically when you interact with us online or with the Website. For example, we use:

  • Cookies (small bits of information that are stored on your hard drive or in connection with your Internet browser), and other tracking technologies to gather information regarding your use and interaction with the Website, third party services, and certain other online activities (including sites you visit, your browser type, operating system, and interactions with our content and emails). This includes a device’s IP address device screen size, device type (unique device identifiers), browser information, browsing history (such as your interaction with our Website), information about the products and/or services that you have purchased or considered via our Website, geographic location (country and time zone, only), and the preferred language used to display our Website. You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. This may prevent you from taking full advantage of the website.
  • Google Analytics, to track the number of visitors to our Website, to provide us information regarding your browsing activities and interests, to process your device’s IP address (processed during your session and stored in a de-identified form), and to assist with debugging and quick logging. You can also download the Google Analytics Opt-out Browser Add-on to prevent their data from being used by Google Analytics at https://tools.google.com/dlpage/gaoptout.
  • Unique Identifiers (such as a universally unique identifier or “UUID”), which we may store (including remotely) on your device persistently and may access, collect, or monitor in order to help you log in and navigate through the Website.
  • Data and Mobile Analytics, to collect information about your website usage, performance data, app errors, and debugging information from where the Website were downloaded. 
  • Log File Information, to learn your IP address, browser type, access times, domain names, operating system, the referring web page(s), pages visited, location, mobile carrier, device information (including IDs), search terms, and cookie information.

We may also learn information indirectly about you, which you make publicly available, such as on a social network or shared with third parties or through our trusted partners. Please note, any content or information you share with or provide to third parties regarding your communications with us, or using or related to the Website may not be private or confidential and is not our responsibility.

How Do We Use Information About You?

We have to have a valid reason to collect, use or disclose your personal information. We may collect, use and/or disclose your personal information for one or more of the legitimate business purposes described in this Privacy Policy. 

We (and/or our Service Providers) may use information about you for legitimate, business purposes; specifically, for:

  • Operational purposes including recruiting and employment-related decisions, accommodating disabilities or health conditions, business planning, audit, compliance, and establishing and maintaining an account for you on our Website;
  • Fulfill or meet the reason your information was collected or provided, such as recruiting and hiring for current and future job opportunities with us or with our clients, including determining your eligibility and suitability for such opportunities (this may include, for example, sending Educational and Professional Background Information, such as your CV, to prospective employers for their consideration and keeping you informed of future work opportunities by email, telephone, mail, text message, and/or other communication methods (note that messaging and data rates may apply for any SMS, MMS, and other electronic communication));
  • Manage and administer our relationship with you;
  • Provide you with information, communications or services you have requested and to contact you in relation to any queries you may submit;
  • Present, optimize, and maintain the security of our Website and their contents;
  • Register, maintain, and provide notifications to you about your Website Account;
  • Detect and prevent fraud or other crimes;
  • Provide marketing and promotions, including sending you promotional communications such as newsletters, surveys, articles of interest, press releases, and job fair or other event announcements and personalizing and delivering content about our Services to you, including through advertisements on our Website;
  • Safety and security purposes including safeguarding the interests of Excelion Partners and protecting Excelion Partners’ know-how, intellectual property, and trade and business secrets, and ensuring the functioning, efficiency, and integrity of our IT systems.

Unless legally required to do so, in certain countries, we do not seek explicit consent to process your personal information when it would be reasonably expected that we would process your information for our legitimate business purposes or for legal purposes, as described herein. For purposes of sending you direct marketing or promotional communications by email or text, we will seek the necessary consent and permission. You have the right to withdraw consent to such activity at any time by email or using the UNSUBSCRIBE option available on the communication. 

Do We Share the Information We Receive About You?

We do not believe that we “sell” your personal information as such is defined by applicable privacy laws, and, accordingly, we do not offer a “do not sell” opt-out. We will not sell personal information that we collected without giving you an express opportunity to opt-out and unless we first give you notice of our intent to sell. We do not knowingly sell the personal information of persons under 18.

We may share or disclose information: (i) with your consent or if you direct us to share personal information; (ii) if you are an California resident, to comply with your requests under applicable law; (iii) as disclosures amongst the entities that constitute the Company as defined above, or as part of a merger or asset sale; and (iv) as otherwise required or permitted by applicable law.

We may also share your personal information with third-party service providers with whom we have entered into contracts that require personal information be kept confidential and prohibit the retention, use, or disclosure of personal information for any purpose other than the services specified. 

We may share or disclose personal information as described, for our legitimate business purposes, described below:

  • Within our Group Companies: We may share personal information internally within our group companies and with our subsidiaries and affiliates. Our personnel may have access to personal information as needed to provide you support, to operate the Website in the normal course of business and to fulfill our contractual obligations and service commitment to you.
  • Third-Party Service Providers: We employ other companies and individuals to perform functions on our behalf, such as providing cloud-based CRM software to support account maintenance and billing, and providing data analytics functionality. They have access to information needed to perform their functions, but not for other purposes. 
  • Business Transfers: If we purchase other businesses or their assets, sell our business assets, or are involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information, including any category of personal data we have collected, may be among assets sold or transferred and may be subsequently used by a third-party.
  • Lawful Requests and Safety: We release personal information when we believe it is appropriate to comply with the law, it is necessary to protect our interests, to prevent fraud or other illegal activity, and to protect the safety of any person. Nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s, request to disclose your information.

How Do We Secure Information About You?

We realize that you trust us to protect your personal information. We take that trust seriously and maintain physical, electronic, technical and procedural safeguards that are consistent with industry standards to help protect the privacy, accuracy, and reliability of personal information and to protect it from loss, misuse, unauthorized access, disclosure, acquisition, exfiltration, alteration and destruction.

We also take commercially reasonable steps to ensure that our third-party service providers reasonably protect and secure your information. If we become aware that a third-party service provider is using or disclosing information improperly, we will take necessary and immediate steps to end or correct such improper use or disclosure.

Any information we hold electronically is stored on secure servers that are protected in controlled facilities. All employees follow a security training program to ensure they have adequate training with regards to handling personal data. 

If, despite our security procedures, personal information is inadvertently disclosed, we shall use all reasonable endeavors to limit and remedy the disclosure; however, to the extent permitted by law, we accept no liability for unintentional disclosure. While we attempt to protect the information in our possession and account for the protection of information provided to our processors and third-party service providers, no security system is perfect and we cannot promise that information about you will remain secure in all circumstances. Please do your part to help us keep your information secure. You are responsible for maintaining the confidentiality of your password(s) and your Account(s), and for all activities that occur under your password or Account(s). We specifically reserve the right to terminate your access to your Account(s) and any contract you have with us related to the use of the Website in the event we learn or suspect you have disclosed your Account or password information to an unauthorized third party.

What Choices Do I Have?

Excelion seeks to ensure all individuals are provided with the rights mandated by their governing jurisdiction. Not all of the rights discussed herein will apply to everyone and, depending upon your jurisdiction, may not apply to you. For example, California Residents have the right, under certain circumstances, to request that Excelion disclose, delete or correct their personal information. However, if you are a resident of certain other states, you may have the right to request that we: 

  • Provide you access to recorded personal information that you have previously provided to us
  • Correct or amend inaccurate information we have about you
  • Delete the collected information assuming that request does not conflict with our legal obligations or other legitimate business purposes for maintaining information
  • Honor your request to opt-out of processing of personal data for purposes of targeted advertising, sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer.

Certain residents may also have the right to appeal our decision about the request.

Notice to California Residents of Their Rights

The California Consumer Privacy Act (the “CCPA”) and as amended by the California Privacy Rights Act (the “CPRA”), also known as Proposition 24, provides California Residents (as defined in the Act), specific rights regarding their personal information. Note that these rights apply to a “natural person who is a California resident” and do not apply to other legal entities such as corporations, which do not have data privacy rights under the CCPA.

Also, for purposes of the CCPA, personal information does not include: publicly available information from government records; de-identified or aggregated consumer information; and, information excluded from the CCPA’s scope, including: health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data, certain information covered by sector-specific privacy laws, such as the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Billey Act (GLBA), the California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994 (DPPA). Any terms defined in the CCPA have the same meaning when used in this Privacy Policy.

The rights conferred by the CCPA and CPRA apply solely to natural persons who are visitors, users, and others interacting with us and who reside in the State of California. The following sections describe your rights and explain how to exercise those rights.

Right to Request Access to Specific Information and Data Portability Rights

The CCPA grants California Residents the right to ask Excelion about its collection and use of the personal information it has collected, used, and disclosed over the past twelve (12) months. Instructions on how a California Resident can submit a verifiable consumer request for access to this information (referred to as a “Request to Know”) are below. Once we receive and confirm that you have made a verifiable consumer Request to Know, we will make an individualized disclosure to you about:

  • Categories of personal information we collected about you;
  • Categories of sources for the personal information we collected about you;
  • Our business or commercial purpose for collecting the personal information;
  • Categories of third parties with whom we share that personal information;
  • Certain, specific pieces personal information we collected about you (“Data Portability Request”); or,
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing: (1) sales, identifying the personal information categories that each category of recipient purchased; and, (2) disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

Right to Request Deletion of Your Data

California Residents have the right to request that we delete the personal information that we have collected and retained (“Requests to Delete”). Upon our receipt of a verifiable request to delete personal information (see below), we shall delete the personal information from our records and will direct our service providers to delete your personal information from their records. 

However, please note that Excelion may deny your request to delete and need not comply with such a request (and need not ask third-party service providers to comply) if retaining the information is necessary to perform certain functions or commitments, including: completing the transaction for which the personal information was collected; providing a service requested; otherwise performing our contract with you or taking reasonably anticipated actions within the context of our ongoing business relationship with you; detecting security incidents and protecting against malicious, deceptive or otherwise illegal activity or to prosecute those responsible for those activities; complying with a legal obligation or otherwise using the personal information, internally, in a lawful manner; complying with the California Electronic Communications Privacy Act; fulfilling the terms of a written warranty or product recall conducted in accordance with federal law; or, for a purpose otherwise contemplated by Cal. Civ. Code Section 1798.105(c)-(d) or as otherwise amended.

Right to Correct Inaccurate Personal Information

The CPRA provides an additional right for California Residents to request that we correct inaccurate personal information that we maintain about them (the “Right to Correct”). Excelion will use commercially reasonable efforts in order to comply with California consumer requests to correct.

How to Exercise Your Access, Data Portability, Deletion and Correction Rights

You may make a verifiable request to exercise your right to access or data portability twice within a 12-month period. To exercise the access, data portability, deletion, and correction rights described above, please submit a verifiable consumer request to us by either:

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf may make a verifiable consumer request related to the personal information about you. If the request is made through an agent, we reserve the right to require a signed authorization or verification of the agent’s identify from you in order protect the privacy of the personal information requested. You may also make a verifiable consumer request on behalf of your minor child. 

We cannot provide you with the information sought in a Request to Know, or comply with a Request to Delete or Correct, if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. A verifiable request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative;
  • Describe your request with sufficient detail that allows us to properly understand, evaluate and respond to it.

We reserve the right to require additional information from you to verify your request before we respond. Any information provided to us in a verifiable customer request will be used only to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We will acknowledge your request or exercise of the foregoing Rights within ten (10) days of receipt with information regarding how we will process your request. We will endeavor to respond to a verifiable consumer request within forty-five (45) days of receipt. If we require more time to provide a response, we will inform you of the reason and extension period in writing. We typically deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the twelve (12) month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

As mentioned above, we may collect or process sensitive data as needed or required to deliver services you have requested. You may request that we delete this information, subject to certain exceptions as provided by the CCPA.

Other California Privacy Rights

Under California Civil Code Section 1798.83 (known as the "Shine the Light" law), residents of California may request certain information about our disclosure of personal information during the prior calendar year to third parties for their direct marketing purposes. To make such a request, please write to us at the address below or at privacy@Exceliongrp.com with "Request for California Privacy Information" on the subject line and in the body of your message. We will comply with your request within thirty (30) days or as otherwise required by the statute. Please be aware that not all information sharing is covered by the "Shine the Light" requirements and only information on covered sharing will be included in our response. 

Non-Discrimination

We will not discriminate against you for exercising any of the rights conferred by California statute, including the CCPA and CPRA. Unless permitted by law, we will not: deny you goods or services; charge you different prices or rates; provide you a different level or quality of goods or services; or suggest that you may receive a different price or rate or a different level or quality of goods or services. 

Changes to Our Privacy Policy

Excelion may modify this Privacy Policy from time to time. The most current version will govern our use of your information and will be located at https://www.excelionpartners.com/privacy-policy. You may contact us to obtain prior versions. We will notify you of material changes to this policy by posting a notice at the Website or by emailing you at an email address associated with you, if applicable, and provide an “at a glance” overview of any changes.
